PROVISIONS

Identity theft

  • Prescribes stronger penalties for taking the identity of another person for the purposes of obtaining employment, whether the person whose identity was stolen is real or fictitious

Licensing penalties for employers who hire unauthorized aliens

  • Prescribes a license suspension of up to 10 days and a three year probationary period for an employer who knowingly employs an unauthorized alien

  • Mandates a license suspension of at least 10 days and a probationary period of five years for an employer who intentionally employs an unauthorized alien

  • Mandates license revocation for an employer who knowingly or intentionally employs an unauthorized alien while on probation for previously knowingly or intentionally employing an unauthorized alien

 

E-verify

  • Requires all employers to verify the legal status of every new employee hired through the E-verify program administered by the U.S. Department of Homeland Security
