![]() E-Verify (formerly known as the Basic Pilot) is an internet-based system operated by The Department of Homeland Security’s (DHS) U.S. Citizenship and Immigration Services Bureau (USCIS) in cooperation with the Social Security Administration (SSA). E-Verify, enables employers to verify the employment authorization of all newly hired employees. The Legal Arizona Workers Act requires Arizona employers to use E-Verify. A.R.S. § 23-214. The law provides that an employer that uses E-Verify to verify that an employee is authorized to work in the United States is entitled to a rebuttable presumption that the employer did not knowingly or intentionally employ an unauthorized alien. A.R.S. § 23-212(I) E-Verify is currently free to employers. In order to participate an employer is required to register online and accept the electronic Memorandum of Understanding (MOU), which specifies the responsibilities of the SSA, USCIS and the employer. E-Verify also features a new Photo Screening Tool, which will allow an employer to validate the photo on each new hire's Employment Authorization Document (EAD) or Permanent Resident Card ("Green Card") against the images stored in DHS immigration databases.
